The Economic Freedom Fighters (EFF) filed a formal complaint against prosecutor Joel Cesar. The allegations center on misconduct in the East London firearm case involving party leader Julius Malema.
The complaint claims that Cesar unlawfully authorized the return of a firearm without a court order. This action allegedly violates the Criminal Procedure Act. The EFF also alleges breaches of the National Prosecuting Authority (NPA) Act and its code of conduct.
Cesar previously prosecuted Malema in this firearm case. That prosecution resulted in a five-year direct sentence after a conviction for violating gun laws by the KuGompo Magistrates Court.
Malema was found guilty of discharging a firearm in 2018, which has drawn significant public attention. The EFF contends that Cesar misled the court regarding the circumstances surrounding the firearm discharge.
During a speech to supporters, Malema called for Advocate Cesar to be held accountable for what he termed an “abuse of power.” He emphasized the need for integrity within the prosecutorial system.
